In compliance with the new requirements of Title IX, the District has adopted the MSBA Board Policy ACA, which states in part: The Mountain View-Birch Tree School District does not discriminate on the basis of sex in its education programs and activities, including employment and admissions, as required by Title IX of the Education Amendments of 1972 (Title IX). All forms of sex-based discrimination are prohibited in the district. MVBT School Board Policy ACA focuses exclusively on sexual harassment as defined in Title IX that occurs within the education programs and activities of the district. However, the district will respond promptly to investigate and address any report of sexual harassment. Sexual Harassment Under Title IX is defined as conduct on the basis of sex within the scope of the districts education programs or activities that satisfies one or more of the following:
An employee of the district conditioning the provision of an aid, benefit, or service of the district on an individual’s participation in unwelcome sexual conduct;
Unwelcome conduct determined by a reasonable person to be so severe, pervasive and objectively offensive that it effectively denies a person equal access to the districts education program or activity; or
"Sexual assault" as defined in 20 U.S.C. 1092(f)(6)(A)(v), "dating violence" as defined in 34 U.S.C. 12291(a)(10), "domestic violence" as defined in 34 U.S.C. 12291(a)(8) or "stalking" as defined in 34 U.S.C. 12291(a)(30).

Reporting Sexual Harassment or Title IX Retaliation: All school employees must immediately report to the Title IX Coordinator any incident or behavior that could constitute sexual harassment or Title IX Retaliation. Any person may report sexual harassment or Title IX retaliation regardless of whether the person is the alleged victim (complainant). Reports can be made in person and by mail, telephone, email, or any other means that results in the Title IX Coordinator receiving the person's verbal or written report.
